1. Acceptance of Terms

 

Welcome to renttoownocala.com (the "Site"). These Terms and Conditions ("Terms") govern your use of the Site and the services described on it. By accessing or using the Site, you agree to be bound by these Terms.

5. The Eligibility Form

 

Submitting our eligibility form does NOT create a binding agreement between you and Rent To Own Ocala or The Table Brokerage. Specifically:

  • Submitting the form does not guarantee approval for our program

  • Submitting the form does not reserve any specific property

  • Submitting the form does not commit you to any future transaction

  • Approval for the program is at the discretion of The Table Brokerage and depends on income, employment, savings, intent, and other factors disclosed during review

  • A binding agreement is created only when a written lease-purchase agreement is signed by all parties

We aim to respond to eligibility submissions within 48 business hours, but response time is not guaranteed.

 

6. Property Listings

 

All property information on the Site is subject to change without notice. Listings are provided for informational purposes only.

 

6.1 Availability

  • Properties shown as "Available" may be removed at any time

  • We do not guarantee that any listed property will remain available until you complete an eligibility review

  • Multiple parties may apply for the same property; selection is at our discretion

 

6.2 Property details

  • Property descriptions, photos, square footage, lot size, and amenities are approximate

  • Construction year and builder information is provided as a courtesy and should be independently verified

  • We do not guarantee the accuracy of property details; buyers are encouraged to conduct their own due diligence

 

6.3 No agency relationship

 

Browsing properties on the Site or submitting an eligibility form does not create an agency, fiduciary, or contractual relationship between you and The Table Brokerage. Such relationships are established only through a separately signed written agreement.

 

7. Pricing & Financial Disclosures

 

Any pricing examples on the Site — including option fees, monthly payments, ownership credits, and lease terms — are illustrative ranges based on typical agreements. Actual terms vary by property and buyer qualification.

 

7.1 Pricing examples are not offers

 

Example pricing shown on the Site (such as "$9,000–$17,000 option fee" or "$2,100–$3,400 monthly payment") is illustrative only. Actual pricing for any specific property is determined during the eligibility review and disclosed in writing before any agreement is signed.

 

7.2 No hidden fees

 

We commit to disclosing all fees, payment amounts, ownership credits, and terms in writing before you sign any agreement. If a fee is not disclosed in the agreement, it does not apply.

 

8. Rent To Own Program Disclaimer

 

Our rent-to-own program is structured as a lease-purchase agreement under Florida law. The following disclaimers are critical:

 

8.1 Not a mortgage

A rent-to-own (lease-purchase) agreement is NOT a mortgage. It is a lease combined with an option to purchase the property at a later date. Participation in our program does not constitute a loan, mortgage origination, or extension of credit.

 

8.2 No guarantee of mortgage qualification

 

Participation in our rent-to-own program does NOT guarantee that you will qualify for a mortgage at the end of the lease term. Mortgage qualification is determined by third-party lenders based on their underwriting criteria, including credit score, income, debt-to-income ratio, and other factors at the time of application.

 

8.3 Option fee and credits

 

The option fee paid at signing is non-refundable. If you exercise the option to purchase at the end of the lease term, the option fee is credited toward your purchase price. If you choose not to exercise the option, the option fee is forfeited.

Monthly ownership credits accrue toward your down payment only if you exercise the option to purchase. If you choose not to purchase, accrued credits are forfeited.

 

8.4 You may choose not to purchase

 

You are not obligated to purchase the property at the end of the lease term. If you choose not to exercise the option, you may walk away with no further financial obligation beyond the forfeited option fee and credits.

 

8.5 Independent advice recommended

 

Before signing any lease-purchase agreement, we strongly recommend that you:

  • Consult with a Florida real estate attorney

  • Review the agreement with a financial advisor

  • Verify property details independently

  • Understand all terms in writing before signing

15. Limitation of Liability

 

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TABLE BROKERAGE, RENT TO OWN OCALA, AND THEIR OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages

  • Any loss of profits, revenue, data, or business opportunities

  • Any damages exceeding $100 or the amount you paid us in the past 12 months, whichever is greater

 

This limitation applies whether the claim is based on contract, tort, statute, or any other legal theory, and even if we have been advised of the possibility of such damages.

 

Some jurisdictions do not allow limitation of liability for certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

 

16. Indemnification

 

You agree to indemnify, defend, and hold harmless The Table Brokerage, Rent To Own Ocala, and their officers, employees, agents, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms

  • Your violation of any law or third-party right

19. Dispute Resolution

 

19.1 Informal resolution

 

Before filing any legal claim, you agree to contact us at ricardo@mytableteam.com to attempt to resolve the dispute informally. We will work in good faith to address concerns within 30 days.

 

19.2 Severability

 

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

 

19.3 Waiver

 

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision later.

 

20. Changes to These Terms

 

We may update these Terms from time to time. When we do, we will:

  • Post the updated Terms on the Site

  • Notify users by email if changes are material (and we have your email)

 

Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

 

21. Entire Agreement

 

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Site. They supersede any prior agreements or understandings.

 

Any rent-to-own program participation is governed by a separately signed lease-purchase agreement, the terms of which control in any conflict with these Terms.
